Does a water heater replacement need a permit in Mecklenburg County?

THE SHORT ANSWER

Not every replacement needs a permit. North Carolina law contains limited exceptions for certain water heater connections in one- and two-family dwellings. Changing the equipment or installation can change the answer. Have the contractor identify the exact scope and confirm the applicable requirements with Mecklenburg County before work starts.

The plumbing exception has specific conditions

G.S. 160D-1110(a)(2) describes an exception when a licensed person under G.S. 87-21 performs the connection, personally examines the completed work, and ensures a gas-piping leak test has occurred. The replacement cannot increase energy use rate or thermal input, or change fuel, energy source, location, capacity, or venting and piping routing or size. Installation must meet the current State Building Code. A similar-looking tank alone does not establish that these conditions are met.

An electric connection has its own conditions

Mecklenburg’s homeowner electrical guidance describes a separate exception for an existing branch-circuit connection to a replacement electric water heater in a one- or two-family dwelling. It requires the same location, no greater capacity or electrical rating, a person licensed under G.S. 87-43, and compliance with the current building and electrical codes. Do not treat a plumbing exception as approval for electrical changes.

Describe the proposed changes before asking for an answer

Make the permit question concrete: identify the property type, existing equipment, proposed model, and everything that would change. A conversation about replacing a tank can turn into a different project after the contractor measures the space. Ask for the determination to be revisited if the plan changes.

  • Is the contractor keeping the same fuel and energy source, or proposing a conversion?
  • Will the tank stay in the same place, and will its capacity and input ratings change?
  • Does the proposal include a new circuit, service work, or changes to venting or piping?
  • Is this a single-family home, duplex, townhome, condominium, or another property type?
  • If a permit is considered unnecessary, which exception applies to this exact scope?

Use Mecklenburg County as the local point of confirmation

The county permitting page links to its permit search and application routes. Trade Internet Permitting is the contractor route for eligible projects; the county identifies the plumbing contractor as the primary contractor for electric water heater changeouts. For scope questions, the Code Information & Resource Center can be reached through 980-314-CODE (2633). Give the actual property address to the county or contractor so jurisdiction and records can be checked. Your ZIP code alone does not settle a permit question.

Agree on inspection handling and the completion record

Before authorizing the job, ask who will obtain any required permit, arrange inspection, provide access, and address corrections. Mecklenburg lists residential water heater changeouts among the inspection types that may qualify for optional live remote inspection. The permit must already exist, and eligibility does not promise a particular inspection time. Ask the contractor which route applies and what record you will receive when the work is complete.

  • Save the written scope and permit number when a permit is required.
  • Request the inspection result and clarification of any remaining corrections.
  • Keep the model, serial number, invoice, and warranty documents together.
